Smiffys is successful in copyright judgement

Published on: 18th July 2019

The successful judgement is against I Love Fancy Dress for copyright infringement.

Smiffys has been successful in securing a judgement at the Royal Courts of Justice, Intellectual Property Enterprise Court, against I Love Fancy Dress for copyright infringement. The Court agreed that I Love Fancy Dress has infringed Smiffys’ copyright by using several of its images on the I Love Fancy Dress website, Amazon and eBay stores, to advertise its own branded product and the branded product of other fancy-dress manufacturers.

The Court ordered that I Love Fancy Dress pay damages and costs to Smiffys in respect of such copyright infringement and further issued an injunction against I Love Fancy Dress to stop them from using such copyright images in the future.

Smiffys has an Intellectual Property and Brand Protection team which is committed to protecting both Smiffys’ own business and the business of its customers. Smiffys has assured that it will continue to pursue infringers of its intellectual property and will take all necessary steps, including the issuing of court proceedings in the IPEC, to enforce its brands and copyright.

Elliott Peckett, director at Smiffys, said: “Smiffys welcomes the judgement and the positive outcome for our brand. We will continue to vigorously pursue any violations of our copyright and the court ruling spurs us to pursue infringers that seek to misuse our Intellectual Property.”
